On 12/14/17, U.S. District Judge Reed O’Connor agreed with a coalition of Republican states that since Congress repealed the tax penalty for not having health insurance the entire ACA is unconstitutional.
Regardless of Friday’s court ruling, as of today, the Affordable Care Act (ACA) is still in effect, and does not impact anyone who has an ACA plan currently, and anyone who signed up or signs up today, will be covered in 2019.
This was reiterated by Seema Verma, the Administrator for the Centers for Medicare and Medicaid Services (CMS), who issued this statement: The recent federal court decision is still moving through the courts, and the exchanges are still open for business and we will continue with open enrollment. There is no impact to current coverage or coverage in a 2019 plan.
We anticipate there will be a drawn-out legal battle surrounding the latest court ruling, and until a final decision has been make, Florida Blue will continue to offer ACA coverage in every county of the state.
